1. Agreement to Terms
By accessing or using Property Point's website and services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
2. Description of Services
Property Point provides end-to-end property solutions including:
- Property buying guidance and consultation
- Interior design and furnishing services
- Property listing on rental platforms (Airbnb, MakeMyTrip, Booking.com, etc.)
- Guest management and booking coordination
- Property maintenance and housekeeping
- Rental income management and disbursement
3. User Responsibilities
As a user of our services, you agree to:
- Provide accurate and complete information about yourself and your property
- Maintain the confidentiality of any account credentials
- Ensure your property meets all legal requirements and safety standards
- Comply with all applicable local, state, and national laws
- Not use our services for any unlawful purpose
4. Property Owner Obligations
If you engage our property management services, you must:
- Have legal ownership or authorization to rent the property
- Ensure the property is properly insured
- Maintain all necessary permits and licenses for short-term rentals
- Disclose any property defects or issues that may affect guests
- Allow reasonable access for maintenance, inspections, and guest check-ins
5. Service Fees and Payments
Our fee structure includes:
- Free Assessment: Property evaluation and income potential analysis at no cost
- Setup Costs: Furnishing and preparation costs as quoted in your proposal
- Management Fee: A percentage of rental income as agreed in your service contract
- Payment Terms: Rental income is disbursed monthly after deducting applicable fees
All fees and payment terms will be clearly outlined in your individual service agreement before engagement.
6. Booking and Cancellation
For properties managed by Property Point:
- Guest bookings are subject to platform-specific cancellation policies
- Property owners may request blackout dates with reasonable advance notice
- We reserve the right to refuse bookings that may pose risks to the property
7. Liability Limitations
Property Point shall not be liable for:
- Damages caused by guests during their stay (covered under platform protection programs)
- Loss of income due to market conditions or low demand periods
- Third-party platform policy changes or service disruptions
- Force majeure events including natural disasters, pandemics, or government actions
Our total liability shall not exceed the fees paid to us in the preceding 12 months.
8. Intellectual Property
All content on our website including text, graphics, logos, and images are the property of Property Point and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
9. Termination
Either party may terminate the service agreement:
- With 30 days written notice for convenience
- Immediately for material breach of these terms
- Upon completion of existing guest bookings (for managed properties)
10. Dispute Resolution
Any disputes arising from these terms shall be:
- First attempted to be resolved through good faith negotiation
- Subject to mediation if negotiation fails
- Governed by the laws of India
- Subject to the exclusive jurisdiction of courts in Gujarat, India
11. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
12. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
